Responsible channel of files.

The LOPD sets out the obligations that the perpetrators of the files or treatments and treatment, both public bodies and private, must meet to ensure the right to the protection of personal data.

Who is responsible?

The Organic Law 15 / 1999, 13 december, of protection of Personal data (LOPD) and its regulations on development, approved by royal decree 1720 / 2007 of 21 december (RLOPD), define the responsible for the file or treatment as the 'natural or legal person, public or private, or administrative body, which alone or jointly with others to decide on the purpose, content and use of treatment, although not materially undertake. Shall also be responsible for the file or bodies treatment without legal personality, which act on trafficking as differentiated subject. "

By file means "everything organized armoury of personal data, which allows access to data according to criteria to be determined, anyone who is the shape or form of its creation, storage, organisation and access' (article 5.1.k) of RLOPD). Moreover, the treatment is defined as "any operation or technical procedure, whether or not to permit automated collecting, recording, conservation, development, modification, consultation, use, cancellation, blocking or deletion, as well as assignments of particulars given on communications, consultations" interconnections and transfers (article 5.1.t) of RLOPD).
